PREDIKSI ANGKA IKUT - KPK menyebut penggunaan rekaman percakapan antara Johanes Marliem dan agen FBI Amerika Serikat di persidangan Setya Novanto punya dasar hukum. Undang-Undang KPK membenarkan proses itu.
"Dasar hukumnya Pasal 12 ayat 1 huruf h atau i Undang-Undang KPK," kata Kabiro Humas KPK Febri Diansyah di gedung KPK, Jalan Kuningan Persada, Jakarta Selatan, Selasa (23/1/2018).
Selain undang-undang, KPK bisa menjalin kerja sama dengan instansi penegak hukum dari negara lain lewat sejumlah konvensi internasional yang sudah diratifikasi Indonesia. Kedua konvensi itu adalah UN Convention against Transnational Organized Crime dan UN Convention against Corruption.
Dalam dua konvensi itu diatur mekanisme pertukaran informasi yang dibutuhkan dalam menuntaskan kasus hukum di negara yang meratifikasinya. Febri juga menyebut pihak FBI sebagai pemberi rekaman tak perlu dihadirkan dalam persidangan untuk memastikan keaslian rekaman tersebut.
"Tidak dibutuhkan, kan sudah ada komunikasi antar-institusi negara. Nanti hakim yang menilai," ujarnya.
Sebelumnya, percakapan Johannes Marliem (bos PT Biomorf Lone Indonesia dan PT Biomorf Mauritius) dengan anggota FBI di Los Angeles, Amerika Serikat (AS) ditampilkan di sidang Setya Novanto. Marliem menyebut ada permintaan diskon 50 persen dari chip untuk per keping e-KTP.
Menurut jaksa KPK, percakapan itu terjadi pada Agustus 2017. Andi Agustinus alias Andi Narogong juga disebut dalam percakapan itu.
Berikut ini percakapan Johanes Marliem dengan anggota FBI pada Agustus 2017 di AS yang ditampilkan saat sidang di Pengadilan Tipikor, Jakarta, Senin (22/1) kemarin:
